ListofDefectsdefinitionSearchWithinListofDefectsDefinitionsRelatedDefinitionsLatentDefectsLatentDefectMaterialDefectQualifiedMortgageMaterialDefectDefectsDocumentDefectManufacturer’sWarrantyProductWarrantyCongenitalCondition(s)ConstructiondefectMaterialDocumentDefectDefectiveWorkTitleDefectsNonconformityNonconformingstructureLimitedWarrantyEnvironmentalDefectDeficienciesNonconformingsignTaxWarrantyDefectUnmanufacturedconstructionmaterialNonconforminguseSpecifiedEquipmentGroundsignDefectsLiabilityExpiryCertificateRemoveAdvertisingOpenSplitViewShareCiteListofDefects meansthelistofdefectsandthecostoftheremedialworksrequiredtoremedysuchdefectssetoutinSchedule19(ListofDefects),togetherwithanysupplementtheretoagreedinwritingbetweenthePartiesasdescribedinClause6.3(a).Sample1Basedon1documents1SaveCopyRemoveAdvertisingExamplesofListofDefectsinasentenceACertificateofCompletionandaListofDefectsshallbepreparedwithparticipationoftheContractor.Finally,on20November2000,ImpresaproducedaListofDefectsthatitproposedtoremedy.DEFECTSCERTIFICATEdaymonthyearCompletionachievedon:Theendofthelastdefectscorrectionperiodis:Thedefectsdateis:ThisDefectsCertificateDateis:(atthelaterofthedefectsdateortheendofthelastdefectscorrectionperiod)DefectreferenceListofDefectsmodifiedbeforethedefectsdatewhichtheContractorhasnotcorrected(oriftherearenosuchDefects,astatementthattherearenone.)CertifiedbytheEmployer:.DEFECTSCERTIFICATEdaymonthyearCompletionachievedon:Theendofthelastdefectscorrectionperiodis:Thedefectsdateis:ThisDefectsCertificateDateis:(atthelaterofthedefectsdateortheendofthelastdefectscorrectionperiod)DefectreferenceListofDefectsmodifiedbeforethedefectsdatewhichtheContractorhasnotcorrected(oriftherearenosuchDefects,astatementthattherearenone.)Workscheckedby:.AllsuchworkshallbecarriedoutattheContractor’sownexpenseforwhichpaymentshallbedeemedtohavebeenincludedintheContractPrice.aTaking-OverCertificateandthosethatmayberectifiedafterissueoftheTaking-OverCertificateunderDefectsLiability.Followingthejointinspection,theContractorshallsubmittheagreedDraftListofDefectsandMinorOmissionsincludingtheagreeddispositionwithrespecttothetimingandmethodofrectificationofeachtotheEmployerforapproval.Duringthecontrol,theEmployershallelaborateaListofDefectsofExecutionandOutstandingItemsandrecordsinittheascertainedDefectsofExecution.ListofDefects,ifany,underCivilCodeSection6000forClaimsofDeveloperConstructionDefects.TheEmployershallrecordremovalofeachdefectintheListofDefectsofExecution.ANNEXURESIfapplicablethefollowingannexuresmustbeattachedtotheagreement:AnnexureA:ListofDefectsandDamageTheRentalHousingAct50of1999requiresalisttobeannexedtotheagreementbytheLessor,settingoutthedefectsinanddamagetothepremiseswhichexistedbeforethelesseemovedin.TheContractorshalladvisethedateforrectificationofeachindividualitemontheDraftListofDefectsandMinorOmissions.TheacceptanceofthisDraftListofDefectsandMinorOmissionsbytheEmployershallconstituteaHoldPointonthesubmissionofapplicationforaTaking-OverCertificatefortheSectionbytheContractor.RelatedtoListofDefectsLatentDefectsmeanssuchdefectscausedbyfaultydesigns,materialorwork-man-shipwhichcannotbedetectedduringinspection,testingetc,basedonthetechnologyavailableforcarryingoutsuchtests.LatentDefectmeansadefectthatexistsatthetimeofacceptancebutcannotbediscoveredbyareasonableinspection.MaterialDefectWithrespecttoanyMortgageLoan,aDefectinanyMortgageFileoraBreach,whichDefectorBreach,asthecasemaybe,materiallyandadverselyaffectsthevalueofsuchMortgageLoan,thevalueoftherelatedMortgagedPropertyortheinterestsoftheTrusteeoranyCertificateholderthereinorcausessuchMortgageLoantobeotherthanaQualifiedMortgage.QualifiedMortgageMaterialDefectAsdefinedinSection2.03(b).DefectsmeansanypartoftheWorksnotcompletedinaccordancewiththeContract,orcompletedwithdeficienciesandflawsandincludesdeficiencies,flaws,etc.developedduringtheexecutionofWorksandduringtheDefectLiabilityPeriod.DocumentDefectAsdefinedinSection2.03(a)ofthisAgreement.Manufacturer’sWarrantymeansthewarrantysuppliedfromtimetotimebythemanufactureroftheGoodsasatthedateoftheacceptanceoftheStatementofWork;“PPSA”meansthePersonalPropertySecuritiesAct1999;“Price”meanstheamountspecifiedwithineachStatementofWork(subjecttoanyVariation)orasotherwisespecifiedfromtheCompanytotheCustomerrepresentingthecostfortheWorks;“RelatedWork”meansanyadditionalbuilding,carpentry,painting,plastering,plumbingorotherworkorothertradesthattheCustomerrequires,whicharenottobecarriedoutbytheCompany;“Services”meanstheservicesprovidedbytheCompanytotheCustomeraspartoftheWorks,whichmayincludewithoutlimitationtheinstallationofGoods;“ServicesDelayCharge”meanstheservicesdelaycharge(ifany)setoutintheStatementofWork;“ServicesInterruptionEvent”meansanyinterruptiontoaWorkscausedby;aForceMajeureEvent,theCustomer’sfailuretocarryoutorperformanyobligationrequiredofitunderthisagreementwhichinthesoleopinionoftheCompanydoesormaycauseadelayintheWorksandanyothermatterwhichinthereasonableopinionoftheCompanywillcauseaninterruptionordelayintheperformanceoftheWorks;“StatementofWork”meansthedetailsoutliningtheprovisionoftheWorks,whichstatementcanbedeliveredverballyorinwriting(includingemail)andmayinclude(whereapplicable)anestimateorquotation(asspecificallyexpressedasthecase)ofcosts;“Variation”meansachangeintheStatementofWorkincludingthespecifications,scope,timeofsupply,priceorscaleoftheWorksandsuchvariationshallformpartofthisagreement;“Workmanship”meansagoodandhighqualityandstandardofdeliveryinconnectionwiththeServicesperformed;“Works”meansthesupplyofGoodsandtheprovisionofServicestotheCustomeraspereachStatementofWork;ProductWarrantyhasthemeaningsetforthinSection6.1(a).CongenitalCondition(s)means(a)anymedical,physicalormentalabnormalitiesexistedatthetimeoforbeforebirth,whetherornotbeingmanifested,diagnosedorknownatbirth;or(b)anyneo-natalabnormalitiesdevelopedwithinsix(6)monthsofbirth.Constructiondefectmeansanyactualorallegeddefective,faultyordelayedconstructionoranyothermatterrecognizedasaconstructiondefectunderapplicablecommonorstatutorylaw,whetherornotasaresultof:MaterialDocumentDefectAsdefinedinSection2.03(a)ofthisAgreement.DefectiveWorkmeans(a)Workthatisunsatisfactory,deficientordamaged,doesnotconformtotheContractDocuments,ordoesnotmeettherequirementsofanyinspection,testorapproval,or(b)WorkassociatedwithpunchlistitemsthattheContractorfailstocompletewithinareasonabletimeafterissuanceofthepunchlistbytheProjectManager.TitleDefectshasthemeaningsetforthinSection5.15(b).Nonconformitymeansadefectthatsubstantiallyimpairstheuse,reliability,value,orsafetyofawheelchairandthatiscoveredbyanexpresswarrantyapplicabletosuchwheelchairoracomponentofsuchwheelchair."Nonconformity"doesnotincludeadefectthatistheresultofabuse,neglect,ortheunauthorizedmodificationoralterationofawheelchairbyaconsumer.Nonconformingstructuremeansastructureorpartofastructurethatdoesnotconformtothepresentbylawsbutwasinconformancewithallapplicablelaws,ordinances,andregulationspriortotheenactmentofthepresentbylaws,includingastructureimproperlyauthorizedasaresultoferrorbytheadministrativeofficer.LimitedWarrantymeansthelimitedwarrantiesandyourcoverageprovidedbyIKOforyourShinglesasexpresslysetoutinthisdocument,andaretheonlywarrantiesbeingprovidedbyIKO.EnvironmentalDefectmeans,withrespecttoanygivenAsset,amaterialviolationofEnvironmentalLawsineffectasoftheEffectiveTimeinthejurisdictioninwhichsuchAssetislocated.Deficienciesmeansdefectsarisingfromnon-conformitywiththemutuallyagreedspecificationsand/orfailureornon-conformityintheScopeoftheServices.Nonconformingsignmeansasignorsignstructure,otherthananonstandardsignorasignthatiserectedandmaintainedinabusinessareaalongascenicbywaypriortothedesignationasascenicbyway,thatsatisfies1ofthefollowing:TaxWarrantymeansarepresentationorwarrantyinSection4.19.DefectAsdefinedinSection2.02(f).Unmanufacturedconstructionmaterialmeansrawmaterialbroughttotheconstructionsiteforincorporationintothebuildingorworkthathasnotbeen—Nonconformingusemeansauseoflandthat:SpecifiedEquipmentmeanstherailwayvehicleswhichtheTrainOperatorisentitledtouseintheprovisionofServicesasspecifiedinparagraph5.1ofSchedule5;Groundsignmeansasigndirectlysupportedbythegroundwithouttheaidofanyotherbuildingorstructure,whichsignincludesthenamesofowner(s)and/ortenant(s)andaddressand/oradvertisesgoods,products,servicesoreventsthataresold,offered,orprovidedonthepremisesonwhichthesignislocatedanddoesnotincludeanyothersigndefinedinthisBy-law;DefectsLiabilityExpiryCertificatemeansthecertificatetobeissuedbytheClienttotheContractor,inaccordancewiththeContract.
