BanksMustProvideNoticeofOverdraftProtectionServicestoConsumers   Beforeoptingintoabank'soverdraftprotectionserviceforATMwithdrawalsanddebitcardpurchases,consumersmustbeprovidedwrittennotice.Inadditiontoexplainingtheoverdraftfees,thenoticetoconsumersmustexplaintheirrighttoaffirmativelyconsenttopaymentofoverdraftsforATMwithdrawalsanddebitcardpurchases.Further,ifthebankoffers,asanalternativeforbankpaymentofoverdrafts,alineofcreditoraservicethattransfersfundsfromanotheraccount,thatinformationmustalsobeincludedinthenoticetoconsumers. Ifaconsumerdoesnotrespondtothenoticebyaffirmativelyconsentingtooverdraftprotection,overdraftswillnotbepaidbythebank. Theconsumermayoptintotheoverdraftprotectionserviceatanytimeinthemannerdescribedinthenotice.Theconsumermayalsorevokeconsentatanytime.Theconsumer'saffirmativeconsenttothebank'soverdraftprotectionserviceremainseffectiveuntilrevokedbytheconsumeroruntilthebankterminatestheservice.  BanksMayNotDiscriminateAgainstConsumersWhoChooseNottoOptintotheOverdraftProtectionServiceforATMWithdrawalsandDebitCardPurchases TheserulesonlyapplytooverdraftfeesresultingfromATMwithdrawalsordebitcardpurchases.BanksmaynotrequireconsumerstoacceptoverdraftprotectionforATMwithdrawalsanddebitcardpurchasesasaconditionforthepaymentofanyoverdraftsforchecksorothertypesoftransactions.Further,abankmaynotdeclinetopaychecks,ACHtransactions,orothertypesoftransactionsthatoverdrawtheconsumer'saccountbecausetheconsumerhasnotaffirmativelyconsentedtothebank'soverdraftprotectionserviceforATManddebitcardtransactions.Additionally,abankmustprovidetoconsumerswhodonotaffirmativelyconsenttothebank'soverdraftprotectionforthesetransactionsthesameaccountterms,conditions,andfeaturesthatitprovidestoconsumerswhoaffirmativelyconsent,exceptfortheoverdraftserviceforATMwithdrawalsanddebitcardpurchases.  Formoreinformation,readtheConsumerFinancialProtectionBureau’sreportontheoverdraftfeerulesandtheimpactonconsumers.
